{"id":90,"date":"2014-03-05T10:44:19","date_gmt":"2014-03-05T10:44:19","guid":{"rendered":"http:\/\/sites.cardiff.ac.uk\/wccop\/?page_id=90"},"modified":"2014-03-05T14:26:00","modified_gmt":"2014-03-05T14:26:00","slug":"5-where-can-i-find-out-more-about-advance-planning-under-the-mental-capacity-act","status":"publish","type":"page","link":"http:\/\/sites.cardiff.ac.uk\/wccop\/resources\/5-where-can-i-find-out-more-about-advance-planning-under-the-mental-capacity-act\/","title":{"rendered":"5.\tWhere can I find out more about advance planning under the Mental Capacity Act?"},"content":{"rendered":"<p>The MCA allows people to plan ahead for future loss of mental capacity through the use of <a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/part\/1\/crossheading\/lasting-powers-of-attorney\">Lasting Powers of Attorney<\/a> (LPAs), <a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/part\/1\/crossheading\/advance-decisions-to-refuse-treatment\">Advance Decisions refusing treatment<\/a> (\u2018Advance Decisions\u2019) and through taking into account Advance Statements where a person states what treatments they would like to be given in the event that they lose capacity in the future. Advance statements are not binding, but they constitute evidence of the person\u2019s wishes and feelings when capable and as such are among the issues in <a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/section\/4\">the best interests checklist<\/a> to be taken into account by the best interests decision-maker when the person loses capacity (see <a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/section\/4\">s4(6)(a) MCA<\/a>). .<\/p>\n<p>An LPA is a document which nominates one or more people to make best interests decisions on your behalf if you lose mental capacity in the future.\u00a0 LPAs can be made either for property and affairs decisions, or for health and welfare decisions (<a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/part\/1\/crossheading\/advance-decisions-to-refuse-treatment\">s9-14 MCA)<\/a>).\u00a0 If people have not made an LPA and they lose mental capacity, it might be necessary for the Court of Protection to appoint a \u2018deputy\u2019 to manage their property and affairs in their best interests (<a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/part\/1\/crossheading\/general-powers-of-the-court-and-appointment-of-deputies\">s16-20 MCA<\/a>).\u00a0 Most health and welfare decisions can be made without a deputy, using the \u2018general defence\u2019 (<a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/section\/5\">s5 MCA<\/a>), so deputies for health and welfare are quite rare.<\/p>\n<p>Advance Decisions allow people to refuse particular treatments in particular circumstances at a future point when they might lose capacity (<a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/part\/1\/crossheading\/advance-decisions-to-refuse-treatment\">s24-26 MCA<\/a>).\u00a0 For non-life saving treatment, it is sufficient for the advance refusal of treatment to be made orally \u2013 although writing it down and ensuring that your doctor and people close to you have a copy is often sensible.\u00a0 In order to refuse life saving treatment at some point in the future, the advance refusal needs to be written down and signed and witnessed.<\/p>\n<p>More detailed guidance on each of these instruments can be found in the MCA Code of Practice.\u00a0 The government has provided <a href=\"https:\/\/www.gov.uk\/power-of-attorney\">online information about making LPAs<\/a>.\u00a0 These need to be registered with a public body &#8211;
