{"id":87,"date":"2014-03-05T10:36:19","date_gmt":"2014-03-05T10:36:19","guid":{"rendered":"http:\/\/sites.cardiff.ac.uk\/wccop\/?page_id=87"},"modified":"2014-03-05T14:25:56","modified_gmt":"2014-03-05T14:25:56","slug":"4-what-are-the-deprivation-of-liberty-safeguards","status":"publish","type":"page","link":"https:\/\/sites.cardiff.ac.uk\/wccop\/resources\/4-what-are-the-deprivation-of-liberty-safeguards\/","title":{"rendered":"4.\tWhat are the &#8216;deprivation of liberty safeguards&#8217;?"},"content":{"rendered":"<p>The deprivation of liberty safeguards (DoLS) were added to the MCA in 2007 in response to a ruling from the European Court of Human Rights called the \u2018Bournewood case\u2019 (<a href=\"http:\/\/www.bailii.org\/eu\/cases\/ECHR\/2004\/720.html\">HL v UK, 2004<\/a>).\u00a0 The Equality and Human Rights Commission have made <a href=\"http:\/\/www.equalityhumanrights.com\/human-rights\/our-human-rights-work\/human-rights-inquiries\/our-human-rights-inquiry\/case-studies\/the-bournewood-case\/\">a short film about the case<\/a>.\u00a0 In essence, the European Court found that the UK needed a system of legal safeguards to protect the right to liberty for people who lacked capacity and who were deprived of their liberty in care homes or hospitals. \u00a0Details of how the DoLS work can be found in the <a href=\"http:\/\/webarchive.nationalarchives.gov.uk\/20130107105354\/http:\/www.dh.gov.uk\/en\/Publicationsandstatistics\/Publications\/PublicationsPolicyAndGuidance\/DH_085476\">DoLS Code of Practice<\/a>, or short a summary is available <a href=\"http:\/\/www.mind.org.uk\/information-support\/legal-rights\/mental-capacity-act-2005\/deprivation-of-liberty-safeguards\/\">on the Mind website<\/a>.<\/p>\n<p>People who are deprived of their liberty under the DoLS, and their representatives, have a right to apply to the Court of Protection to challenge any aspect of their detention.
