The case involved sterilization of an adult woman with learning disability. \u00a0The House of Lords held that if a person \u2018lacks capacity\u2019 and the treatment is necessary in their best interests then the doctors could rely on the common law doctrine of necessity as a defence to an action in battery.\u00a0 In other words, if the doctors considered \u00a0that F lacked capacity to make decisions about the sterilization operation, and they believed it was in her best interests, then nobody \u2013 including F \u2013 could sue them for carrying out the operation without her consent.\u00a0 Over the years the courts developed a further body of case law adding to and refining this judgment, and these rulings formed the basis of sections 1-6 of the MCA 2005.\u00a0 The defence created by the court in <i>F v West Berkshire HA<\/i> is now contained within <a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/section\/5\">s5 MCA<\/a> and is sometimes called the \u2018general defence\u2019.<\/p>\n<p>During the 1990s the Law Commission embarked upon a program of research on \u2018incapacity\u2019 and arrived at a set of recommendations based on the developing case law.\u00a0 Most of their recommendations were eventually incorporated into the MCA.\u00a0 You can read their reports <a href=\"http:\/\/www.bailii.org\/ew\/other\/EWLC\/toc-M.html\">on the BAILII website<\/a> under \u2018M\u2019.\u00a0 The government embarked upon a consultation (<a href=\"http:\/\/webarchive.nationalarchives.gov.uk\/+\/http:\/www.dca.gov.uk\/menincap\/meninfr.htm\">1997<\/a>, <a href=\"http:\/\/webarchive.nationalarchives.gov.uk\/+\/http:\/www.dca.gov.uk\/family\/mdecisions\/indexfr.htm\">1999<\/a>) and <a href=\"http:\/\/www.publications.parliament.uk\/pa\/jt\/jtdmi.htm\">Parliament scrutinized the draft Bill<\/a>.\u00a0 An influential alliance of disability NGOs and professional bodies \u00a0&#8211; the Making Decisions Alliance &#8211; lobbied for the Bill to be passed, and succeeded in securing some amendments to it \u2013 including provision for IMCAs.\u00a0 The Bill was nearly derailed by debates about Advance Decisions, with some concerns that their adoption \u00a0might introduce \u2018euthanasia by the back door\u2019.\u00a0 In the end the MCA was passed after the government introduced a <a href=\"http:\/\/www.legislation.gov.uk\/ukpga\/2005\/9\/part\/3\/crossheading\/declaratory-provision\">specific clause<\/a> saying that \u2018For the avoidance of doubt, it is hereby declared that nothing in this\u00a0 Act is to be taken to affect the law relating to murder or manslaughter or the operation of section 2 of the Suicide Act 1961\u2019.<\/p>\n<p align=\"left\">The MCA was later amended by the Mental Health Act 2007 to introduce the Deprivation of Liberty Procedures, described <a href=\"http:\/\/sites.cardiff.ac.uk\/wccop\/resources\/4-what-are-the-deprivation-of-liberty-safeguards\/\">here<\/a>.\u00a0 In 2013 the House of Lords set up a <a href=\"http:\/\/www.parliament.uk\/business\/committees\/committees-a-z\/lords-select\/mental-capacity-act-2005\/\">Select Committee on the MCA<\/a> to scrutinize evidence on the Act.\u00a0 The Committee will report in March 2014. \u00a0In 2013 the House of Commons Health Committee conducted post-legislative scrutiny on the Mental Health Act 2007 &#8211; which included the MCA deprivation of liberty safeguards (DoLS). \u00a0The Committee described the evidence it heard about the application of the DoLS as &#8216;profoundly depressing and complacent&#8217;, and recommended that the Department of Health should conduct an urgent review of their operation, to report back in 2014 (you can read the report <a href=\"http:\/\/www.publications.parliament.uk\/pa\/cm201314\/cmselect\/cmhealth\/584\/584.pdf\">here<\/a>).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The roots of the MCA lie in a case called F v West Berkshire HA [1991].\u00a0 The case was about whether doctors had legal authority to treat a person whom they regarded as lacking capacity to consent to that treatment.
